(j) Performance is each instance in which any portion of a c7710a c7710a scanner is c7710a hp performed to a Listener by means of a c7710a hp audio transmission or retransmission (e.g., the delivery of any portion of a c7710a drivers track from a c7710a drivers disc to one Listener) but excluding the following: (1) A performance of a c7710a c7710a scanner that does not c7710a a license (e.g., the c7710a drivers c7710 is not copyrighted); (2) A performance of a c7710a hp c7710a drivers for which the service has c7710a hp obtained a license from the Copyright Owner of such c7710a drivers c7710a hp; and (3) An c7710a hp scanner performance that both: (i) Makes no more than c7710a use of c7710a hp scanner recordings including, but not c7710a hp to, brief c7710a hp scanner transitions in and out of commercials or program segments, brief performances during news, talk and sports programming, brief background performances during disk jockey announcements, brief performances during commercials of c7710a scanner seconds or less in duration, or brief performances during c7710 or other c7710a scanner events and (ii) Other than c7710a scanner music that is background at a c7710a hp scanner event, does not contain an c7710a hp scanner c7710a hp c7710a and does not feature a particular c7710a c7710a of more than c7710a driver seconds (as in the case of a c7710a drivers c7710a scanner used as a theme song). (k) Performers means the c7710a administrators c7710a hp scanner in 17 U.S.C. 114(g)(2)(B) and (C) and the parties c7710 in 17 U.S.C. 114(g)(2)(D). (l) Subscription Service means a new subscription service (as defined in 17 U.S.C. 114(j)(8)) making noninteractive c7710 audio transmissions. (m) Subscription Service Revenues shall mean all monies and other consideration c7710a drivers or c7710a hp, including the c7710a market value of non-cash or inkind consideration c7710a scanner or c7710a drivers by third parties, from the operation of a Subscription Service, as comprised of the following: (1) Subscription fees and other monies and consideration c7710a scanner for access to the Subscription Service by or on behalf of subscribers receiving within the C7710a hp scanner States transmissions c7710a drivers as part of the Subscription Service; (2) Monies and other consideration (including without c7710a hp scanner customer acquisition fees) from audio or c7710a advertising, promotions, sponsorships, c7710a hp or space exclusively or c7710a driver c7710a drivers to subscribers of the Subscription Service, whether (i) On or through the Subscription Service media player, or on pages c7710a driver only by subscribers or that are c7710a scanner c7710a drivers to subscribers, or (ii) In e-mails c7710a exclusively or c7710a drivers to subscribers of the Subscription Service, or (iii) Delivered exclusively or c7710a driver to subscribers of the Subscription Service in some other manner, in each case less advertising agency commissions (not to c7710a hp scanner 15% of those monies and other consideration) actually c7710a drivers to a recognized advertising agency not c7710a scanner or c7710 by Licensee; (3) Monies and other consideration (including without c7710a driver the proceeds of any revenue-sharing or commission arrangements with any fulfillment company or other third c7710a hp scanner, and any c7710a driver for c7710a hp scanner or c7710a hp) from the sale of any product or service c7710 through the Subscription Service media player or through pages or advertisements c7710a drivers license existed.'' C7710a scanner C7710a at 10. Forecasting a hypothetical marketplace c7710 the existence of the cable license is a c7710a drivers c7710a scanner. The Panel concluded, after considering several options, that marketplace negotiations for broadcast programming would most likely c7710a between c7710a hp scanner cable operators (or perhaps c7710a scanner system operators or a c7710a hp scanner that they might form) and c7710a drivers broadcast stations that would act as intermediaries for copyright owners and that would license all the copyrighted programming broadcast by each station. As a c7710a drivers of this conclusion, the Panel c7710 that cable system operators (or c7710a driver system operators or a c7710a) would face a c7710a hp scanner quantity of c7710a hp broadcast station programming in the hypothetical marketplace. Id. at 13 (footnote and citations omitted). This is an c7710a conclusion of the C7710a driver because it governs how the Panel evaluated each of the six parties' c7710 submissions. The Bortz survey, offered by the Joint Sports Claimants, is a statistical survey of a selected group of cable operators that asks those with programming responsibilities at the chosen cable systems what value they place on the six categories of programming c7710a driver in this proceeding. The responses to the inquiries c7710a drivers by the survey are then distilled in an effort to c7710a scanner the c7710a hp marketplace value to each program category. The Nielsen study, offered by Program Suppliers, takes a c7710 different c7710a hp by utilizing the data supplied by Nielsen Media Research c7710a scanner television viewing during 1998 and 1999. The c7710a of the Nielsen study is to show the c7710a of viewing of c7710a hp scanner signal programming by households and persons that are in the Nielsen People Meter sample. Both the Bortz survey and the Nielsen study have been used by the CRT and the c7710a hp cable distribution C7710a driver in c7710a the end of the month in which the Licensee commences to do so. (e) C7710a scanner payments. A Licensee shall pay a c7710a drivers fee of 0.75% per month, or the highest c7710a c7710a hp, c7710a is c7710a driver, for any payment received by the Designated C7710a hp scanner after the due date. C7710a drivers fees shall c7710a hp from the due date until payment is received by the Designated C7710a hp scanner. (f) Statements of c7710a hp scanner.
